ACCOMMODATING LACTATING EMPLOYEES

Employee policies meet or exceed CA State Laws for pumping or nursing at work

Best Practices:

  • Written Policy in Employee Handbook

    • Outline employee's rights, how to request accommodation, how the employer will respond, and how to file a complaint​

  • Allow Break Time​

    • A "reasonable amount" of time is likely around 20-30 minutes but is not defined by law​

    • Break time is concurrent with paid break, but taking longer can be unpaid

  • Provide Appropriate Location

    • Not a bathroom, safe, clean and free from intrusion​

    • Close proximity to workspace, access to electricity, a place to sit, and a surface to place a pump

    • Access to sink with running water, and refrigerator or cooler for milk storage
